NagaDrive — nagadrive.com Effective date: [DATE]. Operated by [OPERATING ENTITY NAME] ("NagaDrive", "we", "us").

These terms govern your use of nagadrive.com and our enquiry and booking services, including NagaDrive self-drive rentals and NAGA BLACK chauffeured services. By submitting an enquiry through this site or via WhatsApp, you accept these terms.

1. What NagaDrive is

NagaDrive is a booking intermediary. We operate an enquiry and brokerage platform that connects customers with vetted, independent third-party rental and chauffeur partners in Malaysia, Thailand and Indonesia ("Partners").

We do not own, operate, insure or maintain the vehicles listed on this site. When a booking is confirmed, your rental or hire contract is formed directly between you and the supplying Partner, on that Partner's terms. NagaDrive arranges the introduction, coordinates the booking and supports you through our local agents in Kuala Lumpur and Bangkok, but we are not a party to the rental contract itself.

2. Enquiries and bookings

  • An enquiry is not a confirmed booking. Submitting an enquiry through this site or WhatsApp expresses interest only. No booking exists, and no vehicle is reserved, until you receive a written confirmation from NagaDrive or the supplying Partner setting out the vehicle, dates, price and deposit.
  • Availability shown or discussed before confirmation is indicative. Fleets change, and specific vehicles may be committed elsewhere between your enquiry and confirmation.
  • We will identify the supplying Partner, and provide or direct you to that Partner's rental terms, before or at the point of confirmation.

3. Pricing

  • All prices quoted on this site, in marketing material or in initial WhatsApp correspondence are indicative until stated in a written confirmation.
  • Confirmed prices are set by the supplying Partner and may vary with dates, duration, delivery location, mileage allowance, driver age and season.
  • Unless stated otherwise, quoted prices exclude fuel, tolls, inter-city relocation fees, excess mileage charges and any fines or penalties incurred during the hire.

4. Driver requirements (self-drive)

For self-drive rentals you must satisfy the supplying Partner's requirements, which typically include:

  • A valid full driving licence held for the minimum period the Partner specifies.
  • For foreign licence holders in Malaysia and Thailand: an International Driving Permit (IDP) carried together with your home licence, unless your licence is otherwise recognised under local law. It is your responsibility to hold the correct documents; Partners may refuse handover, without refund, if you cannot present them.
  • Minimum age requirements, which for performance and supercar rentals are commonly 25 or higher and vary by Partner and vehicle.
  • A valid passport or national ID, and any additional verification the Partner reasonably requires.

5. Deposits

Security deposits are set, held and refunded by the supplying Partner, not by NagaDrive. Deposit amounts vary significantly by vehicle class and Partner and will be stated in your written confirmation. Deductions for damage, fines, fuel or breach of the Partner's terms are a matter between you and the Partner, though our local agents will assist in resolving disputes where we reasonably can.

6. Cancellations and changes

Cancellation, amendment and no-show terms are governed by the supplying Partner's policy, which we will communicate before or at confirmation. Unless that policy states otherwise, deposits and prepayments may be non-refundable within the Partner's cancellation window. Requests to cancel or amend must be sent to us in writing (WhatsApp or email is sufficient) and take effect when acknowledged.

7. Your responsibilities

You agree to:

  • Use the vehicle lawfully and in accordance with the Partner's rental agreement, including any restrictions on territory, track use, mileage and additional drivers.
  • Comply with local traffic law in the country of hire, and remain responsible for all fines, tolls and penalties incurred during your hire.
  • Treat handover and return inspections seriously — review and photograph the vehicle's condition at both points.

8. NAGA BLACK chauffeured services

For chauffeured hire, the driver remains an employee or contractor of the supplying Partner. Itineraries, waiting time, additional stops and overtime are subject to the Partner's terms and may carry additional charges. You are responsible for the conduct of your party in the vehicle.

9. Liability

  • To the fullest extent permitted by law, NagaDrive's role is limited to that of an intermediary. We are not liable for the acts, omissions, vehicles or services of any Partner, including vehicle condition, mechanical failure, accidents, insurance coverage or disputes over deposits.
  • Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by our own negligence, or for fraud.
  • Where we are found liable in connection with our intermediary services, our total liability is limited to the fees actually received by NagaDrive for the booking concerned.
  • We are not liable for indirect or consequential losses, including missed flights, events or business opportunities.

10. Website content

Content on nagadrive.com, including text, branding and imagery, belongs to NagaDrive or its licensors. Vehicle images are illustrative; see our photography disclaimer. You may not reproduce site content for commercial purposes without written consent.

11. Changes to these terms

We may update these terms from time to time. The version in force when you submit an enquiry applies to that enquiry. Material changes will be posted on this page with a revised effective date.

12. Governing law

These terms, and any dispute arising from your use of the NagaDrive platform (as distinct from your rental contract with a Partner, which is governed by that contract), are governed by the laws of [Malaysia], and the courts of [Malaysia] have exclusive jurisdiction. Your rental contract with a Partner is typically governed by the law of the country of hire.
